By accessing or using Fetchply ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Fetchply provides an AI-powered chatbot platform that crawls your website, trains a chatbot on your content, and allows you to embed it on your website. The Service includes chatbot creation, management, analytics, and lead capture features.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate and complete information.

You agree not to:

• Use the Service for any illegal purpose
• Crawl or train chatbots on content you do not own or have permission to use
• Use the Service to distribute malware, spam, or harmful content
• Attempt to bypass usage limits or security measures
• Reverse-engineer or decompile any part of the Service
• Resell or redistribute the Service without authorization
• Use the chatbot to impersonate humans or deceive users about its AI nature

The Service offers Free and Pro plans. Free plans are limited as described on our pricing page. Pro plans require monthly payment. Prices may change with 30 days notice. Failure to pay may result in downgrade to the Free plan.

You retain all ownership rights to the content on your website and any data you provide. By using the Service, you grant us a limited license to crawl, process, and store your content solely for the purpose of powering your chatbot.

We do not use your content to train general AI models or share it with other users.

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.

The Service, including its design, code, and branding, is owned by Fetchply. You may not copy, modify, or distribute any part of the Service except as expressly permitted.

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by third-party services (AI providers, hosting, etc.).

To the maximum extent permitted by law, Fetchply is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy of AI-generated responses. You are responsible for reviewing and ensuring the appropriateness of chatbot responses for your use case.

Either party may terminate the agreement at any time. You may delete your account from the dashboard. We may suspend or terminate accounts that violate these terms with notice. Upon termination, your data will be deleted as described in our Privacy Policy.

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.

These terms are governed by the laws of the jurisdiction in which Fetchply operates. Disputes shall be resolved through binding arbitration.
